Terms and conditions as of 2/04/2024



1. Definitions for the Terms & Conditions herewith

RE-WILD = Mr Jason Witts, also known as Jay, is a sole trader & is the EVENT provider.

EVENT = The course, experience or event purchased from RE-WILD

START DATE = The date of the first day of the booked EVENT

LEAD ADULT = The adult nominated to make the EVENT booking on behalf of themself or as the adult representative of a family or other group who will also be leading the group for the duration the booked EVENT


2. Applicability of Terms & Conditions

Please read these terms and conditions and other information that is referred to in herein thoroughly and carefully, before completing any EVENT booking. These terms and conditions are subject to variation by written notice from RE-WILD.  If you have any questions regarding these terms and conditions, please do not hesitate to contact RE-WILD. These terms and conditions shall be incorporated into the contract and shall apply in place of and prevail over any terms and conditions contained or referred to in any communication from the LEAD ADULT or implied by custom or practice.


3. Agreement

Once RE-WILD has received full payment and subsequently confirmed the EVENT booking the LEAD ADULT will have entered a binding contract with RE-WILD on the basis of the terms and conditions detailed within this document. If the LEAD ADULT is representing a group which includes children, the LEAD ADULT must either have parental responsibility or a legal duty of care within their job role for the Child Participant (s) in the group. The LEAD ADULT and any other adults responsible for the children in their accompanying group will be expected to ensure that any Child Participants in their care are aware of and abides by the applicable sections of the Terms and Conditions detailed herewith. RE-WILD reserves the right, without need to give reason and at their discretion, to refuse a booking to any potential Adult Participant or Child Participant. Under such circumstances any payment made will be refunded.


4. Applicable Law

The agreement is governed by English law.


5. Payment

To secure the booking for the selected date of the EVENT payment should be made for the full amount at the time of booking, using the available payment options provided. The time for payment shall be the essence of the contract.

Cancellation of the EVENT by the Adult Participant


If the LEAD ADULT wishes to cancel a confirmed booking this must be made in writing and RE-WILD will acknowledge the cancellation within 5 days of receiving it. Until the confirmation is received by the LEAD ADULT the original confirmed booking remains valid. The LEAD ADULT must be aware that given the relatively small numbers of adults & children attending an EVENT, the EVENT preparation and pre-paid EVENT expenditure by RE-WILD, the following conditions will be applied and therefore they agree to such:


• Where written cancellation is received more than 6 weeks before the EVENT start date all funds will be reimbursed less an administrative fee of £5.00.

• Where written cancellation is received less than 6 weeks before, but more than 4 weeks before the EVENT start date, RE-WILD will reimburse 50% of the total EVENT cost paid by the Adult Participant for them-self and/the group that they represent and the balance shall be forfeit.

• Where written cancellation is received less than 4 weeks before the EVENT start date 100% of the total EVENT fee paid by the Adult Participant for them-self or the group they represent shall be forfeit.

• Where written cancellation is received on or after the EVENT start date or if Lead the Adult together with the group they represent fail to attend their confirmed EVENT, the total EVENT fee paid by the LEAD ADULT for them-self and the group they represent will be forfeited.


6. Cancellation of the EVENT by RE-WILD

Whilst every attempt is made to ensure that the EVENT planned for a specific date takes place, RE-WILD will notify the LEAD ADULT of cancellation as soon as practicable where it is believed on reasonable grounds that cancellation is necessary. Notwithstanding the above, RE-WILD also reserves the right to cancel all and any bookings for any reason at their absolute discretion and in this unlikely EVENT agree to refund all EVENT payments made in full or should the LEAD ADULT agree RE-WILD agree to transfer the EVENT to an alternative date.  Any refunds due will be paid via BACs into the account of the LEAD ADULT.


7. Variation of the EVENT by RE-WILD

By its very nature an EVENT is subject to natural forces, in particular the adverse effect of the wind, and although every effort is made to comply with the EVENT programme, RE-WILD reserves the right to modify the EVENT programme content to match natural variables. RE-WILD also reserves the right to curtail the EVENT in the event of incident, accident, or injury.  Subject to Clause 10 below, in the event of significant EVENT curtailment due to incident, accident, or injury, an alternative date for completion of the EVENT will be offered at no extra cost, should this not be possible a proportional refund will be offered.


8. Force Majeure

RE-WILD shall have no liability whatsoever in respect of any delay or failure in delivery of EVENTs or of any of their other obligations due directly or indirectly to any cause whatsoever outside the reasonable control of RE-WILD including but not limited to act of God, war, invasion, rebellion, riot, civil commotion, disorder, malicious damage, fire, flood, epidemic, quarantine restriction, strikes or other industrial disputes and unusually severe weather.


9. Adult & child conduct, parental supervision & safeguarding children

The LEAD ADULT is expected to conduct them-self in a reasonable manner and to comply with the reasonable instructions and leadership of RE-WILD.  A LEAD ADULT is responsible for ensuring the behaviour of child participants in their group and must maintain behavioural control of their respective child participant(s) is to the satisfaction of RE-WILD. Extra vigilance is required by all responsible adults when activities include the use of fire, hot liquids such as boiling water and sharp tools/objects such as knives and sticks. For the duration of family EVENTs the LEAD ADULT remains (unconditionally and without limitation) parentally responsible for the child participant (s) they are accompanying.


On family EVENTs the LEAD ADULT should always keep the child participant (s) they are responsible for in eyesight. When considering the health, safety and wellbeing of the child participant the adult participant should also pay particular attention to what they would consider adequate parental supervision in relation to:


Toileting

• First aid

• Social interactions with other EVENT participants (including during group games & activities)


RE-WILD has not erected any rope swings in or around EVENT locations and adult participants assumes responsibility for themselves and any children they are responsible for, if they or their accompanying child participant chooses to use any rope swings that might have been erected by someone other than RE-WILD.


RE-WILD reserves the right to remove any LEAD ADULT and any child participants they are responsible for from the EVENT at their absolute discretion without refunding repayment for that EVENT. RE-WILD is also entitled to any reasonable costs arising from removal of said participant which shall be payable on demand. These include (although not an exhaustive list and without limitation):


Alcohol use or intoxication

The use of illegal drugs

Failure to disclose any serious medical condition or disability

• Inability to meet the rigours of the EVENT for physical or mental health reasons

• Lack of appropriate clothing or equipment detailed in the kit list

• Abusive, bullying and other discriminatory behaviour


10. Insurance

RE-WILD has professional indemnity insurance & details are available on request.  Personal insurance covering cancellation or injury is not included in the price for the EVENT.


11. Liability

All EVENTs take place in natural outdoor environments which by their nature are never completely free from hazard and danger and booking on an EVENT signifies acceptance of an element of risk. Whilst it is impossible to list all such natural and non-natural hazards and dangers, RE-WILD has listed those, that is believed to require the most specific care/attention:


• Trip/slip hazards such as branches, logs, roots, brambles, burrows, water-logged ground

Eye level hazards such as branches

• Risk of falling deadwood from trees

Plants that sting and/or cause abrasions

• Insects including wasps, midges, mosquitoes, hornets, bees & ticks

• Deep water

• Exposure to the suns heat and UV rays

• Lightening

• Exposure to wind and rain, particularly when in more open areas


Some of the activities offered during an EVENT are hazardous in nature and booking on a EVENT signifies acceptance of an element of risk.  Should a first aid kit be required one is available on the EVENT, however we recommend all LEAD ADULTS provide & carry a personal first aid kit for the duration of the EVENT.  It is the responsibility of the LEAD ADULT to consider personal medication and other personal health items such as sun protection and insect repellent for themselves and for any children in their group.  For family EVENTs the LEAD ADULT is required to be present should RE-WILD need to administer first aid to any child participant.  The LEAD ADULT should be aware of and make the child participant(s) in their group aware of infections such as Lyme’s and Weil’s diseases. Any participant becoming unwell up to a week or more after outdoor activities should consult their family doctor. It is the responsibility of the LEAD ADULT to ensure that they and any child in their care, take the appropriate precautions before, during and after all activities such as checking for ticks.


All adult participants should recognise their responsibility for their own Health and Safety and that of the Child participant in their charge. RE-WILD has completed a risk assessment to identify outdoor environment risks and specific EVENT activity risks (available on request) and while all reasonable precautions are taken by RE-WILD to minimise these risks.  Adult participants should accept that accidents, including serious injury and death to both themselves and/or their accompanying child participant(s) can occur without RE-WILD being at fault. RE-WILD will only accept liability for physical injury that is shown to result from negligence by RE-WILD. Appropriate safety equipment is provided for the security of all participants & they will be directed when and how to use it by RE-WILD; these directions are to be followed at all times. Child Participants must be closely supervised by responsible adult participants when EVENT activities are close to any ponds. RE-WILD takes no responsibility for any loss or injury occurring because of the adult or child participant’s failure to follow his instruction or comply with his safety guidance. The ADULT PARTICIPANT MUST ACCEPT THAT OUTDOOR ACTIVITIES UNDER TREES IS CONSIDERED HAZARDOUS DUE TO THE RISK OF FALLING DEADWOOD.


RE-WILD also takes no responsibility for any mishap during an EVENT arising from any instruction, safety guidance or information that has not been provided by RE-WILD.  RE-WILD accepts no responsibility for any mishap occurring to third parties taught by any participants of any EVENT. Depending on the EVENT booked the activities and coaching are intended in providing participants with a basic or intermediate skill and knowledge of bushcraft and/or naturalist skills. Before embarking on outdoor activities in remote wilderness the adult participant is advised to seek more comprehensive instruction. Any skills practised away from the EVENT should be undertaken with consideration for personal and third-party health and safety with adequate parental supervision for children. Wild food is discussed during some EVENTs; however RE-WILD recommends that the Adult Participant considers the Law in relation to foraging and that they receive more comprehensive instruction on plant identification before embarking on gathering, cooking and consuming wild food and RE-WILD will not accept any liability in this regard.


12. Medical conditions, fitness and additional needs

Prior to attending an EVENT the LEAD ADULT must fully complete a personal & health form. For family EVENTs the LEAD ADULT must also complete this form for any child participants in their care.  RE-WILD should be informed of any relevant injury or illness occurring to any participant between the time of completing the personal & health forms and the commencement of the EVENT. Medical information provided will be treated in the strictest confidence. To get the most out of an EVENT all participants will be invited to take part in physical & occasionally strenuous activities. EVENT participants are expected to be of good general state of health and RE-WILD cannot be held responsible for any illness or injury occurring as a result of an ongoing medical condition or poor fitness level. Adult participants should contact RE-WILD to discuss their and any accompanying child participant(s) individual needs relative to the EVENT and if there remains any doubt about the ability of the adult or child to meet the rigours of the EVENT they are advised to consult their General Practitioner or other health professionals involved in their healthcare, before confirming the booking.  RE-WILD reserves the right to refuse a booking on medical grounds if it is considered that it will be detrimental to the safety and smooth running of the EVENT. Where applicable, any specific dietary requirements must be discussed with RE-WILD prior to confirming a booking and documented on the respective participants personal & health form. RE-WILD cannot accept responsibility for not being able to deliver special dietary needs at short notice. For catered courses if any participant has a history of life-threatening allergies from substances such as nuts then RE-WILD advises that they provide their own/child’s meals.


13. Customer Care

The enjoyment and satisfaction of EVENT participants is RE-WILD’s business. If participants have a great time please let RE-WILD know. In the unlikely EVENT that any participant has cause for complaint, RE-WILD would appreciate that it is brought to their attention during the EVENT, in order that corrective action can be taken. However, should a problem not be resolved, a complaint should be made in writing and sent by email to us within 28 days of the completing the EVENT. To the extent permitted by law RE-WILD will not be liable in respect of claims first intimated later than 28 days from the close of the EVENT.


14. Damages & Loss of Equipment

For the duration of an EVENT adult participants are responsible for the safekeeping of all equipment issued to them and any child participant (s) they are responsible for. Except for fair wear and tear RE-WILD reserves the right to charge for the cost of replacement or repair of items of equipment lost or damaged during an EVENT.


15. Personal Property

Adult Participants recognises that RE-WILD is not responsible for any loss or damage to the personal property of EVENT participants including money, watches, mobile phones, clothing or other equipment.


16. Photography

Still and moving digital images are sometimes taken during an EVENT. These digital images might be published by RE-WILD for both promotional and teaching purposes and will not be used out of context. RE-WILD will assume that anyone participating in an EVENT (or their parent or guardian where appropriate) give their permission for these images to recorded and used for the purposes described above unless we have been informed before the EVENT start date.  Jay consents to having images of him recorded, however the permission of other adult’s assisting Jay and any adult participants at an EVENT should be sought before any participant photographs them or any child in their care. RE-WILD cannot accept any responsibility for images taken by any adult or child participant during the EVENT.
